Standard Terms and Conditions of Trading

​

These terms form the basis of the contract between our customer and Grace’s Kitchen along with the order confirmation send at time of enquiry. It is your responsibility to check all details in the order confirmation are accurate, as this is the document in which we work to in order to complete your order.

 

Basis of Sale

​

Samples, drawings, and descriptions contained on this website are issued solely to provide you with an approximate idea of the cakes they describe and remain the property of Grace’s Kitchen. The Cake

 

Upon delivery or collection, the cake shall be compliant with the description set out in the order confirmation, be of satisfactory quality, and comply with all food safety, statutory and regulatory requirements within the UK.

We will not be held responsible for customer disappointment with the design of the interpretation of the cake if it is made in line with the pre-agreed requirements set out in the order confirmation and will face no consequent liability. We are not able to replicate other bakers designs, and reserve the right to alter any design sent as inspiration, and add our individual artistic style to a cake. It is the customer's responsibility to check all information and requirements within the order confirmation are correct. 

We will not be held responsible for any damages by you or any third party once the cake has left the premises of Grace’s Kitchen.

Whilst we are able to bake using allergen-free ingredients, it is important for you to note our cakes are made in an environment where nuts, eggs, milk, gluten, and other allergens are present. We cannot guarantee that any cake is entirely allergen-free, though we make every effort to ensure that allergies are accommodated. It is the customer’s responsibility to make Grace’s Kitchen aware of any allergies upon booking. An allergen sticker is provided with every order outlining which of the 14 allergens are present in your order.

Our cakes are made fresh and contain no additives or preservatives and it is our right to assume consumption on the day your order is delivered or collected.

A cake care leaflet detailing more specific care instructions is included alongside an allergen information leaflet for all cakes.

 

All cakes and goods purchased from Grace’s Kitchen remain the property of Grace’s Kitchen until paid for in full. 

 

Delivery & Collection

All orders may be collected, free of charge, from Grace’s Kitchen by prior arrangements. Should you be unable to collect your order at the agreed time, we ask that you kindly inform us by getting in touch through the contact details found on your order confirmation. Should you fail to inform us and there is nobody available when you arrive, alternative arrangements will be made. We give a grace period of 15 minutes before we consider a collection as not occurring at the agreed time.

Once the grace period has passed, we will contact you with a new collection time slot.

We accept no responsibility for damage sustained to an order once it has left the premises. Clear instructions are provided with each order on how to safely handle, transport, and store your cake.

If you have requested delivery, we will deliver the cake on the day set out in the order confirmation to the address provided, though we cannot provide specific timings for a delivery, we will strive to work with the customer to ensure the delivery can be received and works well for both the customer and Grace’s Kitchen. Please note delivery incurs additional costs calculated by round-trip mileage.

 

 

Pricing and Payment

​

The price of your cake (and delivery if this is applicable) will be set out in your order confirmation. A booking fee of £15.00 for celebration cakes and £50.00 for wedding cakes is required to secure the date for your order. All booking fees are non-refundable and non-transferable. No order will be confirmed until the booking fee has been received. If the booking fee is not received within 48 hours, we will release the date in question and cannot be held responsible if we are no longer able to fulfil your order. We will not chase you for your deposit, therefore if the date you have enquired for become unavailable, we will not be able to fulfil your order.

 

A set up fee is required for all wedding cakes being delivered directly to a venue. We will discuss the fee with you when we confirm the final details of your order.

Orders placed with a collection or delivery date within 7 days require full payment. 

Cupcake orders require full payment upon receipt of invoice.

​

For celebration cakes the balance must be paid and cleared no later than 48 hours prior to collection/delivery.

For wedding cakes the balance must be cleared 4 weeks prior to delivery.

Balances can be paid by bank transfer. We do not currently take cash, debit, or credit card payments.

If payment is not received within 48 hours prior to collection/delivery, this shall be constituted as a breach of contract by the customer. We reserve the right to withhold the order until payment has been made in full. When payment is made late, we accept no responsibility should we be unable to purchase the necessary stock or equipment to make the cake as laid out in the order confirmation. In such circumstances, Grace’s Kitchen will aim to fulfil the requirements as close as possible to those in the order confirmation without redress or liability on Grace’s Kitchen.

 

Failure to clear the balance will result in a delay in your cake being baked which may result in your agreed collection/delivery time being pushed back.

Payment of the deposit is taken as acceptance of these Terms & Conditions.

 

Cancellation, Postponement, and alterations

​

As stated above, the booking fee is non-refundable and non-transferable. No order is confirmed until a booking fee has been received.

​

In the event of a cancellation by yourselves, charges are as follows.

Celebration Cakes

·    More than 15 days prior to the date = booking fee only

·    14 to 7 days prior to the date = booking fee, plus 50% of the remaining cost.

·    Less than 7 days prior to the date = full balance

​

Wedding Cakes

·    More than 60 days prior to the date= booking fee only

·    59-30 days prior to the date = booking fee, plus 50% of the remaining balance

·    less than 30 days prior to the date = full balance

 

The above charges are calculated based on the time frames in which we have to purchase the necessary stock, or other items such as personalised toppers, figurines, or decorations. 

 

Any payments previously made are non-refundable.

In the event of a postponement, the payment due remains the same as stated for a cancellation. Subject to availability we will carry forward any monies paid to the new date. Please note we will only do this on one occasion.

In the unlikely event that we need to cancel your order, any monies received will be fully refunded. Grace’s Kitchen reserves the right to cancel, vary or suspend the operation of this contract if events occur which are in the nature of majeure including (without prejudice to the generality of the foregoing): fire, floods, storm, plant breakdown, strike, lockouts, riots, hostilities, non-availability of materials or supplies or any other event outside the control of Grace’s Kitchen, and Grace’s Kitchen shall not be liable for any breach of contract resulting from such an event.

Cancellation due to Covid

​

Should you need to cancel/postpone your cake due to a positive Covid-19 test the same charges remain. 

Should we need to cancel your order due to a positive Covid-19 test, we will refund any monies already paid to Grace's Kitchen and try to recommend another local supplier who may be able to fulfil your order.

 

Alterations

Should you wish to alter the design or size of your order you must inform us in writing of the intended changes. Changes is size or design are subject to our availability and may incur additional charges.

Changes are not able to be made with less than 7 days written notice for celebration cakes, or 30 days written notice for Wedding cakes.

Complaints​

 

Complaints against Grace’s Kitchen are rare, and due to the amount of care and effort we take with each order, we take them very seriously.

 

By paying the booking fee, both parties agree not to post negative information about the other arising out of this contract on any online forum or website without providing advance written notice of the intended content thereof and providing the other party with a prior opportunity to resolve any issue between the parties amicably. 

 

Complaints regarding the decoration of a celebration cake can be easily repaired, errors of this nature must be pointed out upon delivery/collection to give us the opportunity to correct them. If requested, Grace’s Kitchen will provide a photograph of the finished order prior to collection/delivery in order to allow for any amendments or errors. It is the client’s responsibility to check that this meets their requirements and raise any issues with us if there are any discrepancies. 

 

Where the complaint is in regards to the quality of the cake, then the cake or the remainder of the cake/tier must be returned to us as soon as possible after cutting and within 48 hours after collection/delivery to ensure that we are able to fairly assess the nature of the complaints. Please note we can only deal with the client who placed the original order.

General Terms

​

All designs and intellectual property rights remain the property of Grace's Kitchen.

​

We reserve the right to use images of your cake for any form of advertising including web-based promotions, brochures, galleries, and competitions. It is advisable that you make a copy of all documentation received from Grace's Kitchen for your own benefit.

​

Any headings utilised in this Agreement have been inserted for the convenience of reference only and should in no way restrict or otherwise affect the construction of the terms and conditions hereof.

These T&C's are linked on each booking confirmation, by paying the deposit for your cake you are agreeing to the above terms.
